current CP processing times in Mumbai

I got my 140 approved last week.... I had opted for CP on my 140.

My attorney recommends going for AOS instead of CP. One of the reasons he has cited is; he has seen numerous cases where CP interview calls have taken in excess of 9 months.

I had the following questions....

1. Does anyone know about such long wait for CP?

2. What is the current processing time at Mumbai consulate? i.e how long does it take to get the interview call once ur 140 is approved?

3. I will be completing my 6yrs on H1 in March 2004. i.e. no more H1 extension. With this situation, do you think I should go for AOS or CP?
 
CP Vs AOS

I strongly advice you to consider doing CP. Most of the attorney's recommend AOS as they could collect the processing fee, RFE fee etc. If you opt for CP, there role is pretty much over with I-140.

AOS is taking double the time of CP. YOu should talk to others before making a decision. I was also influenced by my lawyer to opt for AOS and it is 1 1/2 years still stuck at INS.

My other friends who applied for CP along with me got their GC six months ago..

Thanks for ur response... I have seen lot of posting where members suggest going for CP. I will definitely do my homework on this one....

You mentioned ur friends opted for CP & got it. Was this very recent ... ie. June, July 2003? One of the reasons (for going AOS) my attorney gave was the current anti-immigrant climate which may not prove beneficial if I opt for CP? Have ur friends had any problem during CP interview? Which consulate was this?

I would suggest to confirm this fact about the fee. I have hired a top attorney who says I have to pay up the full fee whether I do AOS or CP(not the BCIS filing fee ofcourse, but his fee).

This sounds very unreasonable, why should I pay fee if I go for CP? There is no work for the attorney in such a case.But still that is the agreement.What to do?

So, better check out the fee factor.

Ans: For indian consulates about 6-9 months from the time I-140 was approved and if CP was the option specified in I-140.

Ans: As Above. If all goes smoothly then 7 months for bbay (or even 6 months).

3. I will be completing my 6yrs on H1 in March 2004. i.e. no more H1 extension. With this situation, do you think I should go for AOS or CP?
Ans: You will have your GC before then..most likely assuming you follow the all the cp steps and sub-steps in a timely fashion.

As long as you had applied your labor certification 1 year before your 6 year expiration date, you are good to go.

When your attorney, files for 7th year extension, inform him to include labor certification and pending I-140 receipt no. (If I-140 is pending at that time)
 
There are certain requirements to file 7th year extension. If you meet this criteria then yes you would be eligible for 7th year extension. Refer links below and they should be able to throw more light on your question:
