Hi,
my labor certification is from Delaware and i am working for a client of my company in California. My Companys attorney filed the I140/I485 to CSC with ND Oct 03 2003. i got the EAD in Jan and FP done in April and i confirmed with
USCIS cust service guys that filing like this to a different center is fine.

Now i got emails that my I-485 is transferred to Vermont. There is no
status update of my I-140 though. i dont know whats going on.

do you know if the filing date of I-140 and I-485 are going to be preserved
in case of transfers like this.

could somebody explain these things to me..
here is the text from the mail..

On September 22, 2004, we transferred your I485 Application to Register Permanent Residence or to Adjust Status to an office in VERMONT SERVICE CENTER for processing. That office has jurisdiction over the case. They will send you a written decision as soon as processing is complete. You should receive a notice informing you that your case has been transferred to a local office. Please call the National Customer Service Center at (800) 375-5283 to receive information about local office processing times

thank you

As per my knowledge 140 needs to be adjudicated in a Service center that had jurisdiction over the State from where Labor was approved and 485 can be applied either at your Employer's location or your location. That might be the reason for your transfer. I don't know why they did not look at your Labor certification when they approved your EAD and requested FP. They should have transferred it then. This is how service centers work.

I think the received dates and notice dates for your 140/485 applications are honoured.

thanks kmnalluri,
has any one seen a case like this. and if so please let me know what would happen to the filing date of I-140 and I485. In my case I-140 is not yet transferred. i dont know if/when they would do that.
