CSC laguna niguel office, wac-01-247 still waiting.. +need advice on 485

Hi all.. getting a little frustrated with my application. I am a US citizen. I filed a I-130 on April 30th, 2001, for my husband, to California service center, laguna niguel. Received 1st recipt of application notice on 8/6/01 with the 815-825 day est. time frame. I have not heard anything from them since then. Getting through to their 949-831-8427 phone number is hard enough, much like a radio station contest! I finally got through this evening and the machine stated the same 815+ days. OK.. this is a little ridiculous, since it has been almost 1 year. Maybe they are backed up, but this is just plain wrong for a citizen to have to wait nearly 3 years for an application to be processed.

After reading some posts here, I feel as though our approval should come soon :) Now, I have some questions about filing the rest of the paperwork. I read at the ins site, I need to file the following forms: I-485 (status adjustment), I-864 (support), I-693 (medical). On the 485 form, it asks if reason filing is because we have a visa number, so I guess this means we must wait till I-130 is approved? Anyone have experience in sending in the forms first, since they seem to sit in the mailrom for months anyways?

I have tried to talk with a few lawyers, but they all make it sound like this is impossible to do by yourself and their really expensive fee is minimal for all the work that needs to be done.. (sounding like lawyers).

Please, if you have some good advice on speeding up the process of the I-130 or know where I should go from here, please let me know.

1.485 cannot be filed untill 130 is approved.
2.With a little help you can file these your self and dont really need a attorney,but if you can afford it ,it is better to use one.

Start preparing your 485 documentation ,it takes a few weeks to get everything in order.

Please feel free to post your questions to the board and somebody if not me will help out.

About speeding up the process..you can go to the local congressman/senators office with the details of filing and they will be glad to call INS and get a answer for you.

Thank you for helping me with this. I feel pretty alone and don\'t know anyone going through this situation. I will definatly talk to a congressman and keep you posted. Congressman Sherman is the congressman for my area, but read that Congressman Gallegly is on tthe house subcommittee for Immigration. Anyone have any experience with either congressman?

I may have a few questions in a couple of days about filing out the 485 form, which I hope you can help me with :)

Do you honestly think it will take the 800+ days for the 2nd notice to arrive or is that just an "error" like I have read on the web at varous sites?

As for an attorney, I would hire one if I could trust one would work hard for me. I hired someone for the I-130, and boy that was a nightmare of a day I will never forget. If anyone knows a relaiable/honest/hardworking (doubt one has all three qualities if so they wouln\'t be a lawyer right?) immigration attorney in the San Fernando Valley /West Los Angeles area, please let me know.

There is no separate counter for Citizen application processing.
All applications gets the same treatment (of delayed service)

Anyway, the 800 days all that is crab. My feeling is you should get it any time. Goodluck
 
Begun filling out 485 and have some questions.

As a follow-up to my situation, we are awaiting I-130 approval from CSC and would like to start on the rest of the forms to save time.

Here\'s my questions:

1. 485 instructions said my husband has to have the medical report form sent in with the 485. I have read somewhere I think at ins, that they will send a list of INS approved doctors? Maybe I misread it, but can any doctor do it or does the INS require you to have an INS aproved doctor do it? If you need the list of preapproved doctors, do we just call and ask them for it?

2. "Current INS Status" On this part of the form, I am not sure what to put. My husband came here legally, but overstayed his F1, we were married and submitted i245 life act and I-130 on April 30th. He is out of status, but since he falls under life act provision, I am not sure what we\'d write there.

3. In section 3, it asks "list present husband/wife/kds, etc". That must mean I am to be listed, but where it asks "applying with you", I am to select "no", correct?

Thanks in advance for your help. Also, can anyone let me know if they have had their I-130 appoved yet who submitted on April 30th to CSC laguna niguel, with a receipt date of 8/2/01?
