Cross Chargeabiliy -Need HELP

Hi
 I am from india ..one of those high volume countries.
Even though EB2 and EB3 doesnt matter now....there is always a chance of the dates falling back(like it happened last year).
My wife is from one of those other countries where PD is always current.
How can i use that against Cross-Chargeability ?.
What are the conditions for that to use that clause.if any?.

yes you can most certainly do that. go ahead and cross-charge, you never know india/china always go back and forth.

If your wife is born in oner of those other countries you can surely,
cross charge. That is what I am doing. Just make sure to tell your
lawyer to include a covering letter telling that you are cross charging. The law which lets you do that is INA Sec 202.b.2 just
in case your lawyer doesn\'t know that. It is pretty simple and
straightforward
