My I-140 485 filed In neberska my wife's 485 also filed along with me .My wife born in Algeria but citizen of india so is retrogress is going to effect in my case ??

My wife is on H4 right now. And myne is EB3.can i use my wife's place of birth
If i have the option what info i need to send to INS

Please Advice on this
 
Dude,

You say I140 is yours. You cannot use wife's place of birth for retrogression counting. She is a dependant (her I485 is based on your I485).

Yes, I think you can use your wife's COB and go against Algerian 485 quota.
Need to talk to an attorney to see what, if anything, needs to be sent.
