I've a critical situation at home so need to travel soon. But there is a big prob sicne my H1B is in extension process.
My current H1b is expiring on 15th Oct 2007 (with grace period on I 94 as 25th oct 2007). My company has filed for extension but it will arrive say by 25th Oct 2007 etc.
Meanwhile I'm planning to go abroad and come back to US by 13th Oct 2007. By 13th I wont be having visa extension petition/ stamping done and just 2 days of my current visa will be remaining.
My questions are as below :
1. Can I enter US with my existing visa expiring in just 2 days after arrival ?
2. If yes, once I arrive in US, do I need to get I 94 updated again after I get my visa extension by 25th Oct ?
3. Basically , to enter US on H1 visa, how much duration of H1 should be pending after the day you enter?
