Basic info about me:
I work at a big law firm, where people rarely work beyond their 8th year (other than a 3% chance of making partner). I am in my 5th year now. My LC (RIR EB2) was filed in 3/2005. Currently my H-1B is near end of 4th year.
My options:
First, keep my job and negotiate with my boss to work beyond the 8th year, and wait for the LC and GC process to run its course.
Or second, switch to an industrial company with an in-house position or a legal/business position, where there is less of an up-or-out policy.
Key questions in my analysis:
I need to know when realistically I can get my LC and GC. If I can get LC in less than 2 years (the backlog center is closing at end of 2006 so it should be done by then, right?), and if GC will take 3 years from now considering my 3/2005 priority date, then it would be better for me to stick with the current job.
I heard that after retrogression took effect, they are processing the 140s and 485s faster than they thought, so I am guessing 3 years might be enough. If the process will take 4 or more years, it might make more sense for me to get a new job ASAP.
I have decided not to go for PERM -- since the LC waiting period should not affect my priority date. That said, is it possible it's my turn to file 140 and 485 but the LC is still pending?
If I get a new job, then I will of course have to redo the whole thing again. I realize there is a lot of speculation involved but decisions have to be made now.
By the way, my wife is on F-1 so we may be able to use her future employment but that's several years down the road...
