I have a question about meaning of a criminal conviction for immigration purposes. I have read the law and different answers on portal and still confused

I have green card for more that 5 years and in USA for more than 13 years. My ex-wife tricked me in violating order of protection she had since our sepration. I was arrested for violating order of protection with Criminal Contempt of Court which is a deportable offense

Now District Attorney is offering me a plea for Disorderly Conduct which is a violation in New York plus some fine and domestic violence class. My question is that for immigration purposes is it still a conviction if I agree to a lesser charge and take domestic violence class. Can immigration service can still see as I am guily of domestic violence and order of protection violation even on a lower charge. Please advise

Can someone advise me of a good immigration/criminal lawyer in New York area

Did you have an altercation? Why is the word "violence" and "disorderly conduct" coming up?

First of all, you definitely need to consult an immigration attorney as well as a criminal attorney. Do not try to do this on your own. Having said that, the plea for simple disorderly conduct will probably not be a deportable offense but the government may pursue your case as a domestic violence case (deportable offense) and your case may end up in immigration court. You definitely need an attorney whose office is close to the New York/ New Jersey Immigration court and who regularly represents client in that court. At the minimum set up an appointment with one and discuss your case with him/her. Good Luck to you.

Good luck.

Now I am not a lawyer, but my understanding is that a plea deal and/or diversionary sentence is considered a conviction under immigration law. So it sounds to me like you'd still be on the hook for a CIMT which may leave you without the possibility to obtain your USC and may well result in deportation once it comes to USCIS attention.

You really do need to consult some immigration/criminal lawyers experienced in this area.
