Criminal record with marriage

My friend married a guy that she had only known a few months before he went to prison, he has like 11 convictions, including at least one felony. He is in right now and is supposed to have immigration court this month. She says they are trying to get it postponed until he is released. The guy is a real scumbag and I don't see why he would be allowed that priviledge. They married while he was in jail, he has not supported her, they never lived together and as I said only knew each other a maximum of 3 months before getting married, he already knew about possibly getting deported. Would marrige help this guy out at all? I was under the impression immigration proceedings were getting tougher and tougher. Would this guy be allowed to stay stay here even for a little while because of this marriage and despite his criminal record?

Oh there were a couple of things that I forgot, their marriage was kept 'confidential' when the certificate was filed and she has a felony conviction. Also when I first heard of this marriage I thought he was just doing it to marry her or just to stay here. Is there anyway to find out exactly what his status is? Along with that is there anyone I can contact to tell what I know about this guy and the type of character he has, the judge or prosecutors, who and how do I contact? I know this guy will mess her up more if he is let out, she is like a little sister to me and I don't want to see that.

If you believe that this marriage was entered into solely to gain an immigration benefit, you can put your concern in writing and send it to the respective bureau of immigration enforcement office. If you do that, there is a good chance that the ICE goons would pay your friend a visit to investigate. And that is apparently not a pleasant experience. In these cases, they tend to threaten the US citizen spouse with charging her with immigration fraud but generously offer to drop that charge if she files for divorce. There is probably no safe way to 'use' the immigration folks in any positive way, anything you do can and will backfire (and if she has a criminal past herself, you might not want to get the goverments attention on her).

Unfortunately, there is nothing you can do to force women to maintain their own safety. Have you talked to her about your concerns ? If you interfere with her affairs, she might not be so thrilled, even if you have the best intentions.

A question I still have is given this guys record, will he be allowed to stay in this country just because he is married and is there a way to find out his actual status?

One could argue that this is none of your business. If he is not a US citizen, in all likelihood he will be put in removal proceedings. Anything that potentially gives you a prison sentence of 1 year or more causes deportation proceedings. There are near infinite ways to fight deportation, in some of these proceedings being married to a citizen is helpful.
