Create a Petition for late approvals ??

As per AC21 law:
U have to stick with the sponsoring employer for 180 days, before u change jobs. If u don't stick with the sponsoring employer and change jobs before 180 days and suppose ur 485 application gets adjudicated before 180 days, then there are chances of 485 denial.

In such a bad job market it is quite possible that 485 applicants may loose their job before the approval comes through, _after_ a painful wait.

How about a petition stating that:
If BCIS is not able to approve a 485 case in 15 months (Finger Printing validity period), then after 15 months, it cannot issue an RFE and ask for paystubs, company letters etc..The case should be simply approved, unless the application is missing some mandatory documents or was filled out incorrectly etc..

The clause that u need to have the same type of job, similar job title, job in the same field/ area of expertise, for 15 months or more (till GC gets approved), is asking for too much in this kind job market. This rule ought to be relaxed/ loosen up a bit, either by :
- enforcing 15 month period for BCIS.
- OR atleast allowing the 485 applicant to work in other areas/fields, different job types/titles etc..


Do u guys/gals think this is cause enough to raise a petition with BCIS ? Or maybe it doesn't matter, just my 2 cents... :confused:
 
I think it's a wonderful idea!!!!!!!!!! At least they should not ask the salary of new jobs to match the figure on LC.

GC is on the premise that a permanent position exists and citizens or PRs are not available to fill that position. I think your case goes out the window.
