CP with spouse on F-1

hi,
My spouse is on H1-B and I am on F-1. F-1 is purely non-immigrant intent. So will this create problems if I apply for CP ?
Can the consulate officer create problems in CP because I am on F-1 ?.

Anyone in the same boat have any experiences ? (typically everyone here is H1-H4 combo, anyone with H1-F1 combo ?)
 
It's not very clear from your posting who is the primary applicant for the GC, you or your spouse? If it is your spouse & you are only a dependent in the GC process, then in my opinion your current status is irrelevant for consideration by BCIS/consulate. But again, it's just my opinion, I may be wrong.

If you apply for CP, it *might* be a problem while renewing your F1 (if you require), cause then the intent is violated.

But for CP I do not think it should be a problem as far as your F1 status is clean.

I concur with titu on the point that:
If your spouse who is on H-1 has filed for GC as a primary applicant and you are a dependent for GC process then you being on F-1 will not pose a problem whether you do AOS/ CP.

I am not even sure if you can file for GC while being on F-1 since it is visa with non-immigrant intent.
 
You shouldn't have any problems. I did my CP while my spouse is on F-1. No questions were asked about her status. Infact my wife got the F-1 visa from the same consulate. But they never asked any information about it.
