Hello Guys,

I need your advise and any advise you can provide will be appreciated.

I’m a 2011 winner and my visa number is current is Jan 2011 (AS00013XXX). I recently got laid off from my company in the US and now I have to leave the country before end of the year. I decided to go through the consular process initally.

Since my situation have changed now.

1) How can I ask the KCC to reverse my CP application to AOS though USCIS?
2) If I send my adjustment of status application to USCIS will I be considered within status even though my non-immigrant visa is no longer valid after my termination date?

1) As far as I know, you can switch to AOS anytime by notifying KCC.
2) Application for AOS does not extend your visa. If you overstay, you become out of status. And that is definitely not something that an immigration officer might like...
