CP Salary Issues

Hello,

I have applied for Consular Processing and my case has been recently forwarded to the consulate. However, I have a problem in that my current base salary is about 8% less than the salary specified in the LC. Here are some of the issues that I'm concerened about :

1) Is it ok if my current base salary is less than LC salary?

2) If my total compensation (base salary + bonus) satisfies the LC salary requirement, can that be used in the employment letter?

3) If my employer is not able to make my base salary the same as the LC salary at this point, what are my options?

I would appreciate any help on these issues.

{There is absolutely no problem about current salary being
8% less than the figure mentioned in the LC}

2) If my total compensation (base salary + bonus) satisfies the LC salary requirement, can that be used in the employment letter?

{The employement letter should say that your base salary
would be a figure not less than the LC amount}

3) If my employer is not able to make my base salary the same as the LC salary at this point, what are my options?

{The employer should be willing to put on paper that you
would be paid the LC salary on obtaining the Immigrant
visa. You should somehow convince them to give you this
letter}

I would appreciate any help on these issues.

Can you please Answer it here on forum also, much appriciated.

My salary was reduced around 10% , but still falls under all the state guidlines (level 2, whatever).. Should I opt for CP. Assuming if I do what should I say if he questions, why is my salary less then what was stated initial LC.

It is not a problem to be drawing a salary which is 10% lower
than the LC salary. You are supposed to be paid the LC salary
once you obtain your Immigrant Visa.

Just think of some plausible reason, how you can be more
valuable to your company as a permanent resident.

I Agree with Raju.
Even though the officer can verify that you conform with all the information in the underlying petition, It seems that they may be looking at the 'salary' thing just to fulfil one of the 3 major immigration screening requirements. As long as you make enough to meet the US poverty guidelines for the year(depending on the size of your family), you would be exempted from the 'public charge' provision. I dont know if they take close look at I140/LC stage issues, other than making sure still you work for the same employer and same position.

This is just my openion.

Is it possible that the salary mentioned in your appointment letter be MORE THAN the LC salary?
Can there be any issues with this scenario?

Never! I has the exact same situation (30% higher) but it is never a problem. The job should pay *AT LEAST* that of LC salary and the job description should be more or less same as that of LC.
