Does anyone know of a CP rejection case ? I have got my I-140 approved and have opted for CP instead of adjustment of status. I am a little bit concerned about the risks of doing CP and would like to know on what grounds the CPs can be rejected. If you guys know of anyone who failed to get the CP done in India, please post it on this thread. In the worst case, if the CP gets rejected, can I still come to the US after I get my new H-1 - I still have 2 more years to go on H-1. Thanks.

Anyhow, in answer to your questions, CP rejection is quite rare and can happen only in cases of fraud, medical grounds or criminal record.
If you have all required documents, then CP success rate is very high.
 
PT Denial Case

I am a student from India, came for my MBA and successfully completed my course. I had applied for my Practical Training(EAD). There was a major confusion in my case situation. My card was lost in the mail and had to move from one state to another hunting for jobs. Finnaly I landed in Chicago and landed a job, but did not have my card with me. I went to the Chicago District office and got an Interim EAD for 6 months and I started working. I had to apply for a EAD card to Nebreska service center, they sent me a letter after 3 months asking additional information the school infact faxed all the required documents to the INS office. But unfortunately INS has declined my case stating that they wont give EAD for more then 6 months for students in a M - 1 visa. But I am in a F - 1 visa. So I have applied for a motion to reopen my application. So now I cannot work and have to wait. Its been very tough and what other options do I have?

Hey friends ,
could you please help with a few questions regarding CP.What is the current processing time for consular processing for India& do we need to go to India just once for the process?Also suppose we decide to apply for consular processing & then after say maybe a month the priority dates regress & are no longer current does it mean that our consular processing application will not be considered till the priority dates are current again because we know that if we file for adjustment of status that is the case.We are asking this question cos if we apply for CP then we will not be able to get the EAD card & the advanced parole, I suppose?So if we opt for Cp does that mean that we cannot leave the country till the process is complete & also not have the option of changing jobs if needed?

What is the risk of applying for CP?We know that we need to go to India to get the final approval if we apply for CP.Is there a chance of the process getting denied at any stage in the Cp & if it does happen when we are goto India for the interview , can I still enter the USA on the basis of my current H1B Visa? Also when my wife first came to the US ,she came on a H4 visa but since then she has started workiing our here & has a H1B visa now .But both of us do not have our current H1B\'s stamped on our passports.So does that pose a problem for us to enter the USA if something goes wrong with the CP? Would really appreciate all the help we can get!
