CP or AOS ?

In the current scenario, if I am filing for I-140 in california, what would be the better option CP or AOS ? I knew CP used to take lesser time than AOS.

But with the new law of "Concurrent Filing of I-140 & 485, do you guys still think CP will be faster ?

Any valuable input is highly appreciated.

I underwent the same dilema earlier. Finally, decided to go the safer route, AOS.

One has to wait for the I-140 to be approved, before filing CP. With the new concurrent filing of I-140 and I-485, change of status would happen soon, in case of I-485.

Moreover, there is a chance, that there are fewer applications that the INS needs to process now, thanks to the economic conditions and so the I-485 could be faster. optimistic thinking eh ;)

In any case, it would probably vary based on individual circumstances.

Hello I-140 Gurus,

Please let me know, if any of you, have successfully done the following kind of case.

Case: We want to file for I-140 in California Service Center using substitute labour certificate which is approved in Texas by Texas Service Center. Job location mentioned on labour certificate is Texas.

Reason: California Service Center is much faster than Texas Service Center. Also, applicant is on H1 visa residing in bayarea, California and working for a client who is also in bayarea, California. Applicant's employer's head-quarter is Houston, Texas; however employer has a branch office in Bayarea, California.
