Guys,

I filed my I485 concurrently but I was wondering if it would have been better if I opted for CP.

If yes, can I convert my case to CP? I 140 just approved.

Thanks in advance

CP/485

you can convert to cp by applying for filing for 1 824 which takes about 6 months for approval. (at least)
after that the documents get sent to national visa center at NH and then by the time you get cp appointment it could be atleast a year from now.....

moreover, the ac21 provisions do not apply once case is cp....

so its futile in my opinion, there are many posts on that topic, check them out

other option is that you file for 1 824 and then send request to consulate with 1 824 recept and consulate will accept if you can prove hardship......
hope this helps. you are amnongst many others who after seeing the long delays at 485 are now rethinking. the jury us still out as to which process is better

CP/485

There is also the option of the AC-I140 (Attorney Certified) CP. Some consulates like Mumbai , Delhi , London , Montreal permit this. This is a faster process.

The downside to CP is that you are out of the country and have no right to contest , if your Immigrant Visa (GC) is rejected. Also , if you are to lose your job during this process , that could be an issue.

There are a lot of postings on Consular Processing in this forum.

Thanks maverick1976 and hambir
