CP interview before spouses H-4 approval?

I have applied for CP and at the same time i have applied for change of status for my wife from F-1 to H-4. If I get the CP interview before my wife's H-4 approval, would it pose a problem since her F-1 will have expired and H-4 pending for approval.

You need to have the receipt notice for H4 petition on hand. They would definitely ask for proof of contiued legal status.
File pendin adjudication is a proof of continued status until it is adjudicated.

My H1 is expiring on April 30 and I have interview in May 2003. I will not have my approved H1 by May (it is taking 5-6 months now). I am going ahead with receipt notice.

I was under the same impression that H-4 application receipt should be good enough proof of being in status but for whatever reason my company attorney is saying that mail-in signed packet 3 only after h-4 approval. Thanks.
