CP gurus, please help me!!!

After I prepared all the documents for I-485, I found such an ugly fact:

In my I-140 approval notice, it clearly states "We have sent it to NVC for consular processing". My damn lawyer, he still checked "Consular Processing" when he filed my i-140, even though I told him I want I-485 instead of CP.

But I really don\'t want to go for CP. Can I still have the choice to file I-485 directly? Or I have to do a I-140 amendment, and waiting for its approval, then file I-485? or I have to refile the I-140?

Any suggestions are greatly appreciated.

You can go ahead and file I 485 . No need to file any other petition. If your I 140 is approved for CP and you want to go for I 485 ( which is your case) , then there is no need to file any other application . In fact this is the preferred procedure by many lawyers that they chose CP while filing I 140 because you have the flexibility of going through either way

But if your I 140 says approved for Adjustment of Status then you have to file I 824 if you want to go for CP

Your lawyer was smart. He knew changing to AOS from CP is straight forward all you have to do is apply the I-485 and your file will be pulled by INS from NVC. Whereas to change to CP from AOS is a long process. I think that is a smart move.
