CP Gurus help- URGENT

My 140 got approved on 11/08. My lawyer says that I had an CP/485 option open. Hence my understanding is that I824 is not needed to apply.
I am not clear from immihelp.com as to what next steps are and what is the time it is taking currently.

Can somebody help me explaining the process now on, issues faced and time frames that I am talking.

My wife is going to India today due to emergency circumstances and I want to know, if I can get an interview in next 3-4 months in New Delhi. If yes, Then I should apply CP right now!!!.

It takes upto 5 months for CP interview after the 140 approval

NVC must have sent your case by now...... You need to get more proactive and ask your attorney the details.

Was in same situation...

I was in same situation back in Oct. when 1-140 was approved and my lawyers gave me the choice of cp or AOS. After two whole weeks of debate and research and dilly dallying I chose the CP option and my case was received in chennai on Nov.21st. I have the interview on 23rd Jan.
Just got done with medicals today...

3. NVC approved for Packet 3 and sends details to beneficiary and consulate
4. Consulate gives an interview date

So question is-
1. where does packet 4 picture ?
2. what are the docs needed to file for packet 3?
3. What are the risks involved in this process?

1. I140 has AOS/CP option open. -
NOT TRUE - You have specify CP atthe time of 140 filing. (AOS is always open to you, CP is not)
eg- If your 140 was filed for AOS option you have to file 184 if you wanna go CP, takes 2-3 months. If your 140 was filed with CP option you could always go AOS without any additional step.

2. File for Packet 3 at NVC
3. NVC approved for Packet 3 and sends details to beneficiary and consulate
4. Consulate gives an interview date - Originally they sent out an interview letter with a bunch of forms. That was called Packet 4 and you were to take the filled "Packet 4" to the interview

in my case , Delhi consulate
140 Approval Nov 21
P3 hand delievered and Entered on Dec 28
Interview Date Feb 13.

CP Option is @ I140 filing

- You have to file I824 to change to CP after I140 approval.
- Mid course changes were allowed by NVC but don\'t know if they still do.
- Check you I140 approval it will clearly say if its CP.

Sommetimes the service centeres gives you 1 or 2 week withing which you can choose CP and they will forward your file to NVC but its at their discression if they want a I824 or not.

I am for Delhi too-
Today I have asked lawyer to go for CP. They said they will not have to file for I824. That would mean they will file for Packet 3 in next few days.

Hence, what is approximate time you think it will take me (looking at cptracker.com, it tells me within 45 days, I should have my interview date from packet 3 created, but I don\'t know how much time it will take to create packet 3.)

Any inputs ?

after ur attorney sends P3 to US embassy, call them a couple of working days after it reaches Delhi...and request to confirm/ask them to enterP3 into the system...alternatively, if u can send it to somebody and they can hand deliver, thats better cos in that case P3 is entered at the time it\'s hand delivered...
Me and OCt140 were lucky to get Feb interview, though U embassy operators always told us we\'ve no chance of getting Feb interview...
if ur case is created in Jan, u\'ve a chance to get March interview, else April...Good Luck...
p.s.: if u post Delhi specific queries on Delhi related discussion groups, it\'s more likely to get answered and moreso get divergent replies...

I hope I can get my lawyers send papers to NVC quickly and US embassey and let\'s see. I might have to goto Delhi before interview dates come soon... Health issues with my parent-in-laws and hence trying to see how can I form logistics and what I can do before leaving here and hopefully reduce my trip to one rather then two.
