Hello everyone,
I got I140 approved July 2003. My I485 filed November 2003. Now I want to switch to CP but have not withdrawn my I485.
1. Can I withdraw I485 and apply CP at same time?
2. I suppose my husband can apply CP with me at same time?
3. I want to use AC-I140 as US consulate in Guangzhou China accepts AC-I140. Can anybody suggest a good lawyer for that (better if near Boston)?
4. Also, are their anybody doing or having experience CP in Guangzhou China?

Thanks.

{You don't have to withdraw the AOS petition yet. You need
to file a form called I-824 indicating your wisht to change
from AOS to CP. Now a days this approval process is taking
nearly 1 year. However some of the Consulates accept
AC140 with just the filing receipt of I-824}

2. I suppose my husband can apply CP with me at same time?

{Yes. If you are the main applicant he would be the derivate }

{You can deal with the Attorney remotely and hence need
not confine yourself to Boston area. How about Rajiv Khanna?}
4. Also, are their anybody doing or having experience CP in Guangzhou China?

{Read several posts from candidates from this consulate.
You would probably hear from them}

Thanks.

I totally concur with Raju on all the points. In addition, if you do not get quick answers here what you could also do is check http://www.cptracker.com and sort by Interview date and filter by Guangzhou and you will come across timelines and emails of those folks who have gone through that consulate. If you wish you could contact them.

And just to emphasize consult Rajiv Khanna if you decide to proceed with AC I-140.

Thank you Raju595 and Kd1403. I have benefited a lot reading through all the threads while I was filing I140 and now. You guys are really great. I will consider consuling with Rajiv Khana.
From other sites I have heard the Guangzhou no longer accept AC140 anymore, but I don't know whether it is true or not.
So from Raju595, I think I can file I824 and once I get the receipt, I can send AC140 to the Consulate. If AC140 is rejected at that time, I just have to wait for I824 approval, is that right? Do I need to send anything else with I824 (like I140 approval notice)?
Thanks.

Answer: Yes.

Answer: You will need to include photocopy of your I-140 approval notice as a reference.
