I-485 application for my family and me is pending. Now I am planning to visit Delhi with my family in the month of January.

I will appreciate, if anyone can answer my following questions.

Can I go for councilor processing, while I-485 application is pending?

Will it be a good idea?

If yes, what is the procedure?

To change your GC process from AOS (I485) to CP, you will have to file form I-824 with USCIS. After doing that, your lawyer can approach US consulate Delhi with I-824 receipt & the approved copy of I-140 to request for AC-140 (attorney certified). Few things to bear in mind though:

1) AC-140 takes about 3-4 months before the Consulate accepts your case & grant you an interview, so your timings may not work. Search the forum for AC-140 & read the pros-cons more to take an informed decision.

2) If you haven't done so already, search the forums for the pros-cons of changing from AOS-CP before you take the plunge. It may also be worthwhile to discuss your specific case with your lawyer before deciding anything.
