Could you guess what is going on?

Could you give me your best guess about my situation?, my current lawyer is not very informative when giving details.

My I140/I1485 at NSC were denied. My lawyer filed a I290B on 06/25/2004
requesting to be treated as MTR.

Last week NSC sent mail notices to my lawyer stating that the I485 was reopened but that the I140 have not been approved yet and was still being treated as MTR (it has not been sent to AAO).

My obvious question is. How come the NSC reopened a I485 case without approving the I140 first????

Another tip is that my FP process has not been completed yet. I did get the FP notice but my lawyer suggested me not to go since the I140/1485 were denied.

Yes... it was hability to pay.

RFE 04/nn/2004 (Ability to pay)
Denied 05/30/2004
FP 05/28/2004 (Lawyer advice me not to go since I140/I485 were denied)
I290B filed on 06/25/2004
LUD 06/30/2004
