I am on H1, cap exempt that will end on June of 2006 and I have to transfer to cap subject H1, so I will have a gap of 3 mths. Now my wife has to study for GRE (no really) and I am going to babysit during the 3mths, so was thinking of switching her to F1 and me to F2. Only catch is the "intent to stay"; we have GC filed through relatives and also done a hardship waiver of J visa, so would these background stuff make the COS to F status rejected?
