We have filed 485,EAD and AP for me(primary) and my wife on 18th July.Currently both are working based on the H1B visa which is valid until July 2008.
We would like to change my wife's status from H1 to H4 since my wife is pregnant and we are expecting the baby by end of September.
Questions,
1) Do we really need to do COS from h1b to h4 since we filed AOS and may get EAD by another 6 month or so ?
2)What happen if we don't do COS and wife doesn't work because of pregnancy while on her h1b (remember AOS, EAD have already filed)?. Is it considered out of status ?
I think my basic question is, what will happen to H1B & H4 in terms of "status" AFTER you filed your AOS?. Do you really have to worry about COS after you filed your 485 and received your EAD ?.
