convoluted situation- 140 amendment

Hi!
I'm asking for help again, since we are surveying every possible alternative to get the GC sooner.
Here are the facts and thoughts:
We're thinking of doing Consular Processing (AC-140) to get rid for once of this GC stress.
Primary's company merged one day after old company had submitted I140 RFE. I140 approved on old company's name.
Personal lawyer told us not safe to do CP without amended I140.
Company's legal consultant doesn't look to know about any amended I140. Still to find out.
Question: legally, was the company supposed to submit amended I-140 or not? Any hints on where to find legislation on that? From Murthy chats looks like they were NOT supposed to, but some companies do it anyway.

I remember seeing some memo (state department) long time ago... according to that memo amended I-140 was not required for CP.

I would pay Rajiv for a consultation. Even ff the outcome of that paid consultaion does not result in filing of CP, you still can be satisfied that you tried.
