Converting GC case from 485 to CP at New Delhi , please help

Guys,

I have some question regarding converting the GC case from 485 stage to CP:

1) Is it possible to convert my GC case to consular processing after a year in 485 stage?
2) If Yes, how complex would be the case? any risk?

3) In my case CP will be done at New Delhi consulate, How fast is the Delhi Consulate for such cases?

Please suggest. Any advise is appreciated.

It is technically possible, and here is what happens.

a) You would file a form I-824 requesting the case to be
brought to the cp route.

b) Since you belong to Delhi Consulate, you can file a AC 140
(attorney certified I-140) with the I-824 receipt (the receipt
that you get when you file the form) with the Consulate.

c) They will take a decision to accept your case and then allocate
an interview date for you.

d) You attend the interview.

But you have to consider whether it is worth in your case since
you have already spent 1 year in the AOS line.

The above process would take anything like 4 to 6 months.

Research with key words like 'AC140' , 'Form I-824' etc. for some
more information. You should also take your attorney into
confidence and find out whether they are willing to do it this way.
