I am currently on L1B. My 5 yr period expires in late Jan 2006. My GC (EB2 category) processing has just started and is pending Labour. IS there a possibility of upgrading to EB1 and filing I-485 along with I-140 and staying beyond Jan 2006? Or do I have to return back to my country at the end of 5 years? Please advise.
