conversion old labor to PERM

would any one know the procedure of conversion of old RIR to PERM, my old one in philly BRC ( no receipt number ) , and i want to retain old PD
1. do i indicate when i get 45 day letter
2. if the letter does not come by the time of filing , file PERM and indicate there

Old RIR to PERM

I hav read that there are ways to concert, but the DOL recommends filing of an entire new application through PERM instead, meaning rerecruit, unless the recruitment you did for the RIR was done less than 180 days ago. With an entire new PERM applicatino, your case will be processed within the time they claim (45-60 days). Converting from RIR may delay as your old priority date may still be in effect. Unless you have very specific reasons to convert, filing PERM from scratch is the way to go...

If you want to preserve the PD you can withdraw and refile in perm. Your employer/Attorney can send a request to BPC explaining that you are going to refile in PERM idicating that when/where you filed your rir lc. I think, 45 day letter is not a issue. It is difficult to estimate that how much it take to come to your hand.

It is very importaant tht you should exactly copy&paste the every thing in your old lc to new one.
 
At first..it is not a good idea to change..But now wes hould give it a thought.

Option 1. File it in PERM/EB2.. You will get a priority date of Say June 2005. If EB2 gets retrogressed in APRIL 2006 somewhere to 3 years back.. You are struck for 3 years at 485 STAGE..You may still get the AC21 portability and EAD but not the GC.

Option 2. To retain your old PD..by converting the old case in EB3 to PERM...This may help since we are hearing from senate that 65000 new visa numbers might be available under EB3..which if happends will take the EB3 cutoff date for Indians/chineese/philli to a year ahead may be..By the time this happends, if we get our labor in hand..that should be good..

Think it..I am in the same situation..
 
Refiling under PERM

I am in the process of withdrawing old RIR and refiling under perm. There are a lot of steps involved, including registeration with DOL by your employer. All the rerecruitment steps and so forth. I have not withdrawn the old app yet, but if we are able to satisify requirements for Perm, then I'd refile under PERM to retain the PD of July 2003.

are u sending a letter to BRC now or will inform when u file the PERM that u want to refile.
well in my case i qualify for EB2 before and it was filed as Eb2 /RIR, the only reason i want to withdraw and refile is to retain PD of march 2004. hopefully Eb2 does not regress a whole lot.
 
Not sending a letter now. On the PERM application, there is a place to mark that you are retaining your PD and refiling under PERM with identical application.
 
clarification, registration of employer

can u clarify about registration of employer, what does it involve ( does the employer even do it if has already sponsered me before for RIR or may be other applications in the past

can any one help me with my situation please? my labor was filed in July 2002 in MD, so no progress in the last 3 yrs. Meanwhile my company merged with another a little bigger company and adopted name of the other company with new Tax ID nos etc (new joint comapny has 45,000 employess, $ 10 bn market cap). My boss told me last week that they would like to promote me. Now I am wondering if I accept the promotion, what happens to my previous application? Can i file under PERM without withdrawing my earlier application? In case, there is problem with PERM, I can request my company to demote me so that I can continue with my other application. If I file under PERM, will my new application be considered for a different employer, since new company has a different name and TAX id number? I am debating if I should accept this promotion or wait until my earlier labor gets certified. I may not get this promotion opportunity later.

Any suggestions/help will be greatly appreciated. Thanks.
 
is there a way to track PERM CASE STATUS?

IS THERE SUCH A THING!!

MY ATTORNEY SEND ME A LETTER SAYING THEY SUBMITTED PERM TO DOL ON 4/8/5 I WOULD LIKE TO TRACK MY CASE??? ANYBODY PLS HELP??

ALSO MINE IS A CONVERSION FROM RIR TO PERM TO KEEP MY PD..

The sooner the employer registers, the better.
 
PERM filing and old Labor Application

Hey Guys
I have a query, Can I keep old traditional GC process running (which is in the BRC...) and file also for new application thru PERM?
or
I have to withdraw my old GC application and then and then only I can file for new application under PERM..

As per my understanding - if you wish to retain the old priority date then you need to withdraw the old case and file a new under PERM.

But you can also keep two sperate cases one under old proceeses and another under PERM. Though I have seen contradicting info on Rajiv and Shila Muthy's site on this. You need to validate this with some lawyer.
