Conversion of I-485 appln. from EB3 to EB2.

Guys please help,

My I-485 was filed in EB3 in July\'01. I also got my EB2 I-140 approved in Oct\'01. Can I convert this same EB3 I485 appln to EB2 I485 appln by sending this new approved I140 notice.

If not, do I have any other options (as it looks like the Priority dates will retrogress by Jan\'02 and then definitely the EB2 I485 cases will be approved earlier than EB3 I485).

Yes you can

First try to call IIO ask them what to do. If you are lucky some IIO will do it for you through computer and ask you send your new I-140 directly to them, but it is not always happen. You can also send a letter and your I-140 approval notice along with the A# you got from your pending I485. They will include letter into your pending I-485. If both EB3 and EB2 PDs are current, there is no sense to send another I140.
