Conundrum

Hi All,

Thanks for this site. I need advise. Bear with me there will be a question. My friend was just picked up on 3rd degree felony charges, he was arrested, spent the night in jail and released on his "OR",he has a hearing scheduled in about 2 weeks, he has been out of status in the US for about a year, he is from Italy and holds an Italian passport. He doesn't want to attend the hearing against all advise from those who are close to him and is dead set on leaving the country. I explained to him that if he leaves without attending the hearing his chances of getting back into this country are basically slim and none.

If he does indeed decide to leave, and we are still working getting him to do the right thing, will he have a problem at the airport, could he be arrested trying to leave the country, I'm just not sure, I don't know the kind of information sharing the various agencies do.

Any help would be greatly appreciated, thanks
 
He most likely will be able to leave without any problems especially if he leaves before the hearing. But like you said if he leaves he most likely wont be able to come back here unless the law changes. For one he will most likely have a 10 year ban for the overstay. Also he will have a warrant for his arrest issued when he does not show up in court and would be arrested at a POE should he ever try to return.
