Is it legal to enforce an employment contract that stipulates
paying damages back to an employer if one terminates employment
on an H-1 ?
A person I know signed such a contract and is thinking of breaking
it. I recently heard of a case in CA where signing such a contract
with the employer under H-1 was held to be illegal. Is this true in
general: will the employer have to prove that the damage caused was
real ? Any advice will be much appreciated. Thanks.
