Hi,

I have a valid H1B approval till Feb 2011 but expired visa on my passport and i also got my advance parole.
I have to travel to canada due to some emergency.

Has anyone traveled to canada and back to u.s.a based on the contiguous territory rule ? I have valid I-94 attached to the I-797 approval form.

Please see this link:
http://travel.state.gov/visa/laws/telegrams/telegrams_1441.html

Please let me know asap if anyone has any idea about this. i talked to the lawyer but i want to confirm with someone who has taken advantage of this rule.

Thanks in advance.

Yes the content in the link from your e-mail serves as the basis for Auto Re-validation for re-entry. You need not use the advanced parole. However, please make sure that: 1. You still maintain H-1B status, and 2. You do not have a visa stamping appoinment at any U.S. Consulates in Canada.

contiguous territory rule. (Auto revalidation)

I went to canada on saturday and came back on tuesday (1/1/2008) using the contiguous territory rule. The officer at the border asked me 3 questions:

1) Country of citizenship ?
2) When was the last time you travelled out of u.s.a. Since then did you travel to any other country ?
3) are you bringing in any food/meat etc. from canada ?

This rule rocks.
