Our petition was forwarded to AILF Board of Directors, Board of Trustees and Legal action center staff.

I would like to discuss about legal action against USCIS with AILF legal action staff.

Please let me know your thoughts about this and also provide me some inputs for discussion.

Things to discuss with the AILF legal team.

1. Can we File a Las Suit against USCIS regarding the backlogs
2. How much it would cost.
3. How much time it will take.

Things to discuss in the Forum.
1. How many are ready to contribute money towards the law suit expenses.
2. Try to finalize this by the end of this month.

I am ready to contribute money.

Edison is right...

I went to meet this lawyer who I thought could be our help in sueing BCIS...but it was waste of $150 for 1 hour.

What he thinks about it :

Yes, We can sue them and for sure thats how it will work but for that we need a attorney who specialises in class suit.

It will cost us around 50k to 100k . LCA (Legal council of America)
conducts those...lawsuits.

He says every one is frustrated...and he will help me if he hears back from any of his buddies who want to take our case.

So here is my contribution towards this thread.

Re: Edison is right...

Thanks for your efforts. This work should be undertaken by lawyers and firms who have done it in the past. Not all lawyers have this experience and many are too scared to ruffle USCIS. So I would say it is not a waste of time but a very valuable feedback. As Kashmir said, it is a step in the right direction.

Thanks

Appreciate your effort.

sanju13,
Your effort is very much appreciated. It is not a waste of money and time. Thanks.

Need to do something

We need to keep trying and every body should contribute money in case we file a lawsuite. Nobody will give his 100% for free. It is very important to be united instead of Criticizing somebodys effort. At the end we all will be benifited. If we loose think that we got a pay cut or something but if we win atleast it will give some hope to immigrant population in this country.
Try Try again and at last you will succeed.
I even think the people who even got green cards should not show us there back at this time and also pay for this cause. Again whatever we do to speed up GC process will in turn benefit all immigrant population. Start thinking collectively. Remeber UNITED WE STAND.
Even if we don't have any rights in this country but we are paying BCIS for there service. They can deny our cases but they can't keep us hanging like this. If they don't have enough resources then they should hire more. This is not our problem. They can charge future GC applicants more.

I think we should write a letter to BCIS director, demanding an explanation for the backlog, tell them if they don't reply in 15 days, we're going to sue them.

They never replied our petition, let's tell them all the ppl on the petition are going to sue them.

The letter should be short and precise.

Pay

I will Pay $200, now you need 999. Money doesn't matter GC matters. Everybody needs to think how much more flexible it would be if they have GC.
Think about your TV broke and you need to buy one. People who don't have jobs or are on bench don't need to pay. People who are working can contribute for rest of the non working community.

This is BCIS director's home address

Let's send our petition to his home address

dengdeng, Carl Shusterman has the martindale-hubbard rating of AV* (excellent ). Murthy has BV* (very good).
Carl might be the guy. But first you guys need to collect money. It is difficult planning on an empty fund.

Money???

Can somebody start a poll on how much ppl. will be willing to contribute to this effort.

poll questions could:
I'll contribute:
$10 - $50 (one time)
$50 - $100 (one time)
$100 - $250 (one time)
$250 and above (one time)
$1 - $10 (per month for a year pledge)
$10 - $20 (per month for a year pledge)
etc etc...

It would also show the attorney that we are serious and would be a moral booster for whoever is leading the effort (Edison et al...)

Lawsuit is gonna cost money...the more we can contribute, the better lawyers we can get.

2ns step would be to setup a trust account and writing the checks. Personally, i'll start saving by eating noodles just to get BCIS in court.

Somebody needs to take a lead and non-profit organization needs to be opened.
Organization needs to be headed by some citizen if possible. Then we can all send our checks to that Organization. Now we need to find out who can help us with that.
Also need to find a name for organization.
It would have been helpful if ISN.ORG could take up this effort but I don't know if they would help us.

Go for it!

My full support for any action and will like to contribute. First we should get a good lawyer, find the approx. amount and then set up the contribution amount. Hats off to dengdeng, edison and others. Go for it.

Willing to contribute

Good thoughts!! Once we have some estimate, people would be more forthcoming I think. Edison, sai and others, keep up the tempo. I am willing to contribute to this cause.
