We wish to draw your kind attention to the difficulties faced by highly skilled legal immigrants in getting employment based green cards due to a strange phenomenon known as "Prority date retrogression"
My priority date is 03/18/2002 Category: EB3 Country of Birth: India
In June 2005 the priority date for category EB3 India was June 2002.
In July 2005 the visa numbers became unavailable for EB3 since the annual quota for employment based green cards had been used up.
When my family members and I had our interview for adjustment of status at Dallas district office of USCIS in September 2005, we were told our cases are approvable but have to wait for visa numbers to become available and the annual quota for employment based green cards for the financial year 2006 will be available from October 2005.
However in October 2005, the priority date for EB3 India travelled backwards in time and was fixed at January 1998. In the last 6 months this has inched towards February 2001.
There appears to be no justification for such a heavy retrogression.
Could you please ask USCIS to release the following data::
Number of employment based green cards issued in the current financial year 2006 and the breakup categorywise for EB3 and particularly for EB3 India.
We fear that the annual quota for employment based green cards will remain unutilized due to the strange phenomenon called retrogression.
We request your kind intervention in this matter to end retrogression and make employment based green cards available to highly skilled legal immigrants.
