Sub: Employment based EB3 retrogression
We thank you for your efforts to streamline the immigration process. In this context we want to draw your kind attention to the heavy retrogression faced by applicants for employment based adjustment of status.

Could you please ask USCIS to provide the number of employment based green cards approved so far in the current financial year 2006 and the breakup for number of green cards approved under EB3 India which is heavily retrogressed? We fear that the annual quota for employment based green cards will remain unutilized because of the retrogression (which appears to have no basis)

The office of the Citizenship and Immigration Services Ombudsman (CIS Ombudsman) is charged with assisting individuals who experience problems with the United States Citizenship and Immigration Services (USCIS) benefits process. This office cannot instruct USCIS to provide a legal exception to a statutory mandate, such as [the statutorily prescribed numerical limitation of visas available per year.] Once available visas have been issued, USCIS has to pause with the final adjudication of a petition or application until new visa numbers become available. ]
