Consulate denied my friends daughters application

Hello Everyone,

I would greatly appreciate your feedback. My friend is a US Citizen and applied for citizenship for his minor daughter born in Mexico. However, the consulate denied her application because of the minor medical condition (Autism-nonresponsive) under section 1A3 (Section 212(a)(1)(A)(iii). Can someone please elaborate on why?

I don’t understand much spanish but that looks like the denial was for an immigrant visa, not for a citizenship application.
It seems they can apply for a waiver of that using form 601.



fyi this is the English version of that section
INA 212(a)(1)(A)(iii) of the Immigration and Nationality Act provides that an individual is ineligible for a visa if the individual has a physical or mental disorder and behavior associated with that disorder that may pose, or has posed, a threat to the property, safety, or welfare of the individual or others, or a history of such behavior likely to occur or lead to other harmful behavior.
