I am new to the forum and am going through this site. I have doubt which would appreciate if the experts could direct me.

I was in the US on H1, but am in India for the past 1.5 years. I have opted for CP at the time of I140 submission itself. My I140 got approved in End-Dec 03. Broadly after that the following events occured
1)awaiting Visa Fee letters from NVC.
2)Visa Fee letter comes to my lawyer
3)My lawyer sends it to my company
4)my company sends it back with fees
5)lawyer sends it back to NVC

Now, I am awaiting Packet 3.

Do i need notorised employement letter from my current company?

Also, I have an approved and Valid H1. Do I need to have H1 to work in US or I can go through some procedure as I am on final stages of GC?

The cases I went through was the cases of person going for CP and is working in US. But my case is I am in India. Could somebody send me the path at this site of my type of case (a CP and the person is in India/not-in-US).

BTW, mine case will be handled in Mumbai Cons. and have got the BMBxxx no. When can I expect this BMB no. to displayed for my tracking at the "http://mumbai.usconsulate.gov" site?

>>GC is for future job,there is no requirement for anybody to be working for a sponsor company.But should work for US sponsor company after GC for about 6-12 months.

>> Don't worry we are on same boat.Mine was AOS approved I-140 and got changed to CP (after I-824 approval).And now waiting for NVC P3 review.

Further, instead of waiting for Packet 3, can I go ahead for Police clearance, now. Will it be valid? I have got the sample Packet 3. I belive PCC will take some time and hence the thought came.

Also, I stayed in US for approx one-and-a-half years. So will I need to get Police clearnce from US?

{You would need the PCCs at the time of the interview. Hence
this may be good time to start working on them.

Since you are currently living in India, I hope you know that
you need to obtain 2 PCCs , one from the PP office and the
other from local Police authorities}

{No PCC is required from US authorities for your stay in US.
They have the ability to trace your record on line from your
SS number and other details}

If your current co. is the same as the sponsor co. then YES. I do not think, you need if they are differing. You need the notorized employement letter from the sponsoring co.

Just a clarification....One definitely needs a notarized letter for cp interview from the GC SPONSORING employer. GC sponsoring employer can be your current employer or future employer depending on each gc case.
 
Are you sure no PCC is required for US stay

Hi Raju,

I have got a sample Packet 3 from my lawyer. In that there is nothing specified that for the period a person has stayed in US, there is no need for any police clearance as they can get it through SSN.

I stayed in US for 1.5 years until mid-2002.

Raju, what is the source which tells that no PCC is required for US stay.

Although I am new to this forum, guys, this forum is EXCELLENT. and it is EXCELLENT only because of the people who share their knowledge and/or experiences.

There is no requirement for PCC in usa stay since USCIS/ Consulate has the ability to pull up the entire record of any individual based on SSN and/ or Tax Id where SSN is not issued. Since this is readily available it is a known fact that there is no need to carry PCC for usa.

But if you still choose to you can write up an application and walk in to a local police station and get one in couple of weeks! Not sure what the process would be! But all i can say is take comfort in the fact that no PCC is required for stay in usa when raju says so!
