Consular processing rejection

state and regional is approved for me.Now i am thinking whether i have to go for consular processing or AOS.IS any rejection is there if i go for consular.My H1-b is expiring next year 2003.Can i extend the H1-b.If something happen can i come back

You have a long way to go appan! First you need to file for I-140,then think of CP or AOS.

If you opt for CP and it is rejected, you cannot come back to USA. Normal procedure is that they would cancel existing visas (H1/L1 etc) unless they have good reason to give you some more time to get additional documentation to clear CP. If they decide not to approve, you cannot enter US.

At the time of I-140 you have to opt for CP or AOS. However choice is yours according to your present job condition. If you think you can survive in the current job till end of CP (approx 20 months) then I think CP is the best option.

I don't know why do you feel for the chance of rejection !!! They can't reject a case if they wish to !!!

If you opt for AOS, at least you can get an EAD within 3 months of concurrent filing.

I suggest you compare both and take a quick decession as you have to file the I-140.
