Hello All,

I have filed both I140 and CP together . Now I have some questions

1) Does I140 Need to be approved before I can get an interview date for CP ? How long does it take to get the interview date after I140 is approved

2) Do I need to do medicals here? or In India . I thougt we need to do it India ?

3) How long does this whole process take (I140,CP assuming Texas service center & Chennai Consulate

Major Confusion!!!

485 refers to application to adjust status- which is what is commonly known as AOS and is quite different from CP or Consular Processing. Also of note, while one can apply for I140 and I485 together, one may not do that with I140 and CP. In your case, it appears that you have applied for I140 and I485 together- check the 485 threads for more information. Good luck.;)

I meant CP and not 485 .

Will I be able to get an EAD even though I am doing CP .

Do I need to do medicals here? or In India . I thougt we need to do it India ?

It is still not clear what you have filed, have you filed I-140 and I-485 concurrently or just filed I-140 with CP option? It helps if you can ask questions with more clarity.

Why don't you answer more clearly? Why do you simply copy your previous post? Please answer, what have you filed: I-140 only with CP option or I-140 with I-485? DO not copy previous post again!!

OK, so you have filed for I-140 with CP option. This option does not give you the ability to apply for EAD, it is only for those who file I-485. YOu can file for either CP or I-485, not both.
After I-140 is approved it is forwarded to NVC for further processing. NVC sends you a bill fo rthe fees and then sends you packet3. After you file packet3, NVC will review it and send it to Chennai US consulate.
You will have to do medicals at a doctor authorized bt the US consulate in Chennai.
The entire process will take 6-10 months AFTER I-140 approval.

One more clarification

So Does the 180 Day rule apply in this case .. By the 180 day rule, I mean If I had done I140 and 485 together, then 6month into my 485, I can change employers without going through the whole process again

Does this also apply over here. I have filed for I140 & CP . Six months frrom now, am I in the clear with respect to changing jobs and not going through this whole process again

Please let me know

No,

For CP you have to stay with your sponsoring employer until you enter the US on an immigrant visa. The so called 6 month rule- 'AC21' provision does not apply to CP.

As Rajeev has said in the reply to your question, changing or losing jobs in CP process is a BIG NO. If you change or loose your current job with your current employer (sponsor), you come back to the start of GC process again.
