Consular processing H1B with AOS pending

Dear my most hallowed forumites -

I was on H1B for a year then got laid off, and had to stay at home for 2 months while looking for a job. I got a new job, and then in process of getting an H1B transfer, CIS responded and said my H1B had been approved, but they were denying an extension. To get the extension, I'd need a valid passport and thus proceed to my home country for consular processing.

Now I worry if they would let me back in (due to the 2 month or more violation of staus), and wonder also if the embassy would grant a visa.

I also have a pending AOS from a marriage. So what should I do? Follow my employer who is pressing for me to get a visa stamp abroad so I could be back at work ASAP? Or ignore my employer and wait for an EAD and avoid being banned from coming back?

What say you my peoples?

I don't want to cheer for the Redskins from outside the border.. its not as much fun!!!!!!!!
