Considering Asylum

Hello All,
As you can make out I am considering Asylum in USA. I am presently in India, Mumbai and in trouble here for my views on the corrupt and voilent political happeninngs and conducts here.

I have a B1/B2 visa for USA and considering to take political asylum there. I have visited USA before and however once was also stopped at the PoE and returned under 212 clause about a year or so back. Never tried after that.

Now as total newbie I wanted to request if someone could have the patience to tell me how do I apply for asylum in USA.
How will it proceed if I buy a ticket to usa and arrive there at the PoE. Do I have to say I am applying for Asylum immediately to the customs officer or do I tell him I am visiting USA and if denied entry tell him I want asylum ?

Also will they put me in lockup or similar at that point or simply return me back to India ?

Please be considerate to share your knowledge. I have more questions and hopefully will find good souls here to help me out

I think you should apply for asylum at the POE if you know you might have some difficulties getting into the country. Because if you first say you want to visit the country and you are refused, changing your intention of entry to say you want to appy for asylum after being refused entry for visitation purposes might raise eyebrows.

Thank you for the link. Would you know how it works from the moment I ask for asylum ? I mean are we put in "quarantine" or in Jails or what happens in the steps that follow. Also does it make a difference to which port I apply and them move to in USA ? I mean in case i come in across the border from Canada near NY could i move to Texas or California and continue the process there ?

I think you are put in detention until your case is resolved. gone are the days where they let you go after 1 night.

So make sure you are ready to be detained for a long time.

:eek: Are you sure until the case is resolved ????? How long is that ? Seems quite improbable ! Maybe they give your the 3rd degree too ? :p Trying to break you where your own country failed :confused:

if you say you have fear and want to apply for asylum at the POE, you will be handcuffed and taken to jail and you could be detained as long as 6 to 8 months.
Now, You should land at an POE city where you have freinds or family members cos the jail officials and immigration agent will ask you while you are in about if you have any family members or anyone you know who will take care of you if you get released while your case is heared. So keep them in mind. I myself haven't applied asylum at POE but I have know few who did. If you are not at risk for admission in the US, you shouldn't ask asylum at POE cos it's so boring and painful to be locked up in jail for many months like a crazy criminal.

It is not improbable. They can't let you out even if you have realitives in the country because they want to make sure you are the person you say you are. Also national agency checks etc.

Gone are the days when you showed up to seek asylum and then sat in the system until it was processed. If the officer at POE thinks your claim is bogus, he/she will send you back. Now a days asylum hearings are done in few months rather than years.
 
Wowee !! That sure throws the option of applying for Asylum at PoE. But is there anyone here who can confirm the detention aspect. Why would i be imprisioned am I a criminal ?
 
i was in us for nearly 6 month and exited the country. when i tried to come back after a month or so they assumed i had immigration intent and allowed me to withdraw my application. I could try to come in on b1/b2 visa and see how it goes .... but this is a serious situation however i am not keen to languish in detention or similar

I dont think you would have any problem if you want to come back. I personally know of a person who did the same and was turned back. He came back in 1 year and they let him after questioning him.

but if you want to apply for asylum..thats another story.
 
could you share his story about about why he was denied and if he was allowed to come back from the same PoE or another one.
I am sure the All PoEs share the data. I have nothing marked over my passport
