Congressman enquiry not replied to

Info

I824 case approved 11 th aug 2004- cable sent to London on that date but not heard anything more

SO

My congressman sent an enquiry to Texas on 21st Jan 05 and as they did not repond sent a second enquiry on 21st Feb- still heard nothing from TEXAS!!!


What can anyone suggest!!!!!!!! is my next step as they seem to be ignoring him

Would u like to share that 824 for to follow-up 140 or your case is FTJ? (following-to-join spouse/immidate relative)


anyway, it is assumed that u have received official approval notice of 824. in both case 140/FTJ send a letter with certified copy of ur approval (I824). they would take care rest of it.

Btw in FTJ case I would advise u to read this ,
start from current page and read all pages upto 76>

Hi

My husband was I140 and I485

Son was in UK doing education so husband did I824 follow to join for him


Husband sent 1st I 824 in Jan 2002 and Texas worked the I824 before husbands I485 was approved so denied 1st I 824. Got separated from file.

Told to do a new I824 once husbands I485 was approved.

Did 2nd I825 and although approved and cable sent to London on 11th Aug 2004 The London consulate say never received it.

First of all do not panic. I can und that thisis painful situation for parents.
I am assuming that your son is <21 yrs.

First you must understand what 824 is , its purpose is to issue 'Duplicate Notice of an approved petition' choice of counsulate/country. it should be filed after 485. and it looks that they are confused with ur old 824. which was denid.


Anyway. Here is simple process ppl are following and even their familes are in Ind/Pak/sri south east Asia. and having no major prob with it.

UK consulate should resposne ur application. anyway.

Here ppl are doing. before u also und that 824 is not necessary in FTJ case. and ppl got their spouse/children here even 824 is pending or never filed. yesssssss neverrrrrr filedddddddd 824. I already posted a link that is specialy for FTJ cases. u must read from pate 52- 76> pages tu und.

in short summry the following info I shared with many of friends and ppl who asked me to my understanding with FTJ process. and mostly are spouse case. but you can read this there is very minor diff in doc which I wrote is additional for spouse or child.

A copy of the original application or petition that was used to apply for your immigrant status
A copy of the I-797, Notice of Action, for your original application or petition
A copy of your alien registration receipt card or I-551

If the I-824 is approved, the USCIS will notify a U.S. consulate that you are a lawful permanent resident so that your spouse can apply for a following-to-join immigrant visa. Your spouse must then contact the local U.S. consulate to complete the processing.

As I learned from fourm mostly applicants shared are from southeast Asia Ind/Pak.

After approval and Stamped on PP

1 Immidiately file 824 and get official receipet (ND)

2. the following doc will be sent to home country consulate tor request them to create spouse case.
824 receipt
G.C copy both side
485 approval
Passport copies all pages of all passport even expired.
485 application / petition copy (ur att should have it)
Your marriage certificate
spouse Birth Certf
cover letter asking to create case for spouse and send them all to consulate.


Additional doc, as many ppl sent to save time. otherwise it will be asked to bring at consulate intervew time and some they would send packets to ur spouse/children to fill it out.

I-134 support (Org - must Notorized)
Empl Letter (Org - get more copy from empl)
Bank letter (read 134 req on form - must also state Total Number of deposit last year. ask ur bank and do mention to put they would charge extra to put 'total $ deposit last year'. and ask bank to issue as' Sponser Letter for Imgg' usuaaly current bal, account since, avg bal etc)
W2 (2 yrs )
Tax returns - 2yrs (certified)
DS-230 Part I and part II forms signed by ur spouse
Marriage Certf
Spouse Birth Certf
Police clearance Certf
Medical would be done when they ask to do b4 interview

As many ppl did send all doc once to consulate, few of them their spouses /children got DS-230 form again and were asked fill it out.

I believe if except DS-230, Police certf,Medical, if all rest of doc are sent to them the chances are they would create the case. here I would like to read this (read the part where says Post record does not exist)

according their guildeline they have to create case of spouse and to follow next step. if we send all doc to them, in first step. chances are they would send DS-230 I+II to spouse and as soon they would receive they would send letter for Interview with check list of other doc Police Certf+ Medical. Org I-134, and others.

My understanding with 824 application is just the official protocol. if G.C notorized copy+ PP is provided they will go ahead and process.

Btw remember in 824 there is no spouse info column all info is ur, spouse info will be written in seperate plain paper. I haven't fill it out but there are many ppl who shared about 824 issues from page 50-72.

Read this doc and read the part 'When Principal Adjust Status' it clearly says that consular officer should create the case.

Assuming u haven't got cas number then
Call them ask them to verify us that u did receive our doc?. They can't refuse to answer ur question. ask them to give u case number?
this consulate is in UK not other country.....

If case No has been assigned then, State Dept would follow ur request and will send the cable to them based on Visa Catagery+chargeability and then issue the visa number for ur son.

if u think that ur visa number should be current, or u came to know that they have delying because of some reason. u must contact to them, not TSC.

The UK consulate can verify that principal/ur spouse status has been adjusted. you can contact to head of immig visa dept of US cons in UK. prefer call directly and talk.


Btw Have u sent them all Notorized doc?

Did u get case number?

I did send all documents you mentioned by certified mail to London
on 21st Jan 05

The consulate in London will not allow you to have an appointment neither do they speak to you on the telephone

All I can do is write another letter (again copy doc's) and re-send to London to ask #Did you receive 1st cert mail? and can they issue a case number and proceed?

But what can I do when they just do not answser my 1st letter, it is my guess they may not answer the 2nd letter either


and yes you are right my son is now over 21years. His 1st I 824 was applied for within one year of visa availabilty and pending at enactment of CSPA so he should be covered by that.

Ay least that is what I have been told!

This is so upsetting, his father, myself, and two brothers are in the US and he is stuck in the UK on his own

if u don't find try all.

Just to let you know I tele the London consulate and there is no way they will speak to you

Everything has to be done in writing.

The operator said to send an e-mail to them and so need to wait to see if they reply

In the meantime I have booked an appointment with Senator Marintez office for next friday in Orlando

The lady said they can only do what congressman Weldon's office is doing but hope it might make a difference

I will post any outcome

Thanks for update.

Its really weird, anyway don't worry, you still have to quick options, Email and Fax,

Send them email and Fax it also. ask them atleast let you know that they got your son's paper? and the case number.

If you didn't hear anything in two weeks. keep sending fax.

Best thing is ask and let ur attorney to send, they do act to attoney more quickly than individuals.

Just a quick up date

Today my congressman received a reply as follows

The I824 was approved 8/9/04 and the notification was sent to the Consulate on 8/11/04

The file is not sent to the consulate on a follow to join. We first send notification that the Pricipal has been approved and the dependant has to appy at the consulate

My enquiry said London says it has not received cable!!!!!!!!!!!!!! I thought they would check with London and maybe send cable again (too simply) but


I have waited two months for them to tell me exactly what it says on the ucis web site!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!




Dahhhhhhhhhhh! Their brains must surely hurt!!!!!!!!!!


Question. They say dependant has to apply at the consulate , but I cannot find any info on either usic web site or London consulate web site for any sort of instructions as to what dependant needs to do

Does anyone know????????
