I am in the process for NIW. I concurrently filed I-140, I-485 and I-765. I received working permits for my and my wife a few weeks ago. Does this have some kind of positive meaning? Does it mean that at least the BCIS is considering the possibility of granting the petition? Or, the two processes have no connection.

As niwniw said, the approval of your work permits (I-765) has no bearing on the outcome of your I-140. I-485 ofcourse cannot be approved until your I-140 clears.

Good luck.

Hi ,

But i think i read some where if i am not wrong that the INS officer goes through your I-140 on a preliminary review before he approves your I765 or AP.

Sri

The INS(CIS) Officer just "goes through" the I-140 before approving the I-765.

What he checks is if the primary applicant satisfies the basic requirements of the category under which the petition is being filed.Once he is satisfied that there"might" be a case, then he issues the EAD.

However, this is TOTALLY different from I-140 Approval.

Issuing an EAD means in NO WAY that the I-140 has been or will be approved.

ONLY AFTER the I-140 finally gets approved, will the real work on I-485 or Consular Processing begin.

One thing is for sure about those Boston dudes:

they may not keep laughing for long!

They have just wasted money and time and more importantly, in my personal opinion, they have compromised their future petitions,in which they would definitely have to give the details of this filing and the reason for denial. Surely their current petitions will be denied even without an RFE,unless otherwise their adjudicator is an undergrad college dropout or they win a Nobel Prize in the meantime.

But if they really deserve at the present stage, then I hope their petitions get approved.

I am not in favor of taking these vital steps in one's career/life without realizing the possible future-repercussions.
