confusion about required documents for AC21.

Hi,

I am working as consultant for on-site client. The cilent is offiering me permanant position. I have EAD and applied for I-485 1 year back.

The HR department of company is asking for all green card documents like Labor approval and I-140 petition. My current employer is holding all those. All I have is my I-485 receipts, EAD and AP documents. Is it enough to switch to new employer and continue green card processing by filing AC21?

Please advise.

and fill out the form G-639 to request for the documents for your case number. I think you can request your labor certification (ETA750 part A and B) and I-140 copies.
I have not done that for myself as I have all these docs, but I heard/read that they will take about 2 to 4 weeks to get the copies.
 
Thanks hr0803 for your reply. This is an excellent URL and can ask new employer's immigration dept. to fill out the form and get copies.

Meanwhile, I was surfing through some of the AC21 related forums here and found that you really do not need I-140 or Labor approval notices to change employer during I-485 stage. Is it safe to change job without these approval copies? Can it hurt my GC process or EAD renewals in anyway?

My employer also does not give labor and 140 copies. I am not planning to change jobs but can I still use FOIA to get the details without hampering my application. Please let me know.
 
Some people say labor certification and I140 copies are not required for AC21. But I would send all possible supporting documents that I have for my satisfaction.
Even if you are not sending these as you do not have them currently, get them thru FOIA and keep the copies with you.

Really? You can get something that does not belong to you but your employer??? Has anyone got the copies of the LC and I140 through the FOIA?
 
I heard that the FOIA process takes planty of time get copies of I-140 approval. So, I some how managed to get I-140 and Labor approvals from my employer.
However, new company's immigration dept. now asking me about complete I-140 application. Is it really required to port green card process?

I thought copies of Labor approval. I-140 approval and I-485 receipts should be sufficient to file for AC21 and port green card processing.

Please share your thoughts.

No, it is not necessary. As long as you provide them with Job Description, Educational Requirements and Salary, it should be ok.
