hello everybody

i got a weird situation here.

i filled for aos in 2002 and they havent really been telling me much during the past 7 years.

now i got a letter last week from the texas office telling me to come in for my i-89.

today i got a letter from the memphis office that my case has been denied and i am being deported. that letter was dated septmeber 2004. and it had the wrong address on it.

why is my stuff in memphis when i am in texas.
how can i get letters from them send to me at the right address and then on to the wrong one.

i am confused.
it is the weekend so i cant even call a lawyer.

and what is a i-89 form?

the office in san antonio tells me my case is pending but the memphis one says it got denied.

any ideas what could be going on?

i am confused. am i here illegally? on the online status it say case pending.

i am scared of having to leave now. i have three kids and my husband is deployed and i cant reach him.

thanks for any info

Online thing is a joke. Did you apply for EAD or AP during this time?

The I-89 is a white, cardboard form bearing the applicant's signature and index fingerprint on two sides. This is used in generating the plastic "green card." The INS prepares the I-89 either at the time of the adjustment of status interview or, in cases when there is no interview, at the time the applicant appears at INS to obtain a "temporary evidence" stamp in his or her passport after the I-485 has been approved.

but then it makes no sense.
why would one office send me to come for the i-89 and another one (that is in the wrong state) deport me?

It seems like one wants me to come for the green card. And I am guessing they are doing that without an interview because my husband is deployed to Iraq.
And the other one is sending me back home.

How can they have two different states working on it?

i did the ead. never applied for ap. never left the counrty in seven years.
i never worked either, i am a stay at home mom.

You might have missed an appointment for biometrics or interview, or they might have messed things up.

Have you ever lived at the wrong address or it's just similar to correct one, did the USPS forwarded it to you with a yellow sticker or USCIS overrided the wrong address? The A-number on both letters the same yours? The receipt numbers the same yours? The priority date the same yours?

thats what it said is the reason it got denied, i missed two appointments.

i did live at that address, but at the time the denial letter came to that one we havent lived there for over a year. i changed my address and even got letters at the new address.

it never got forwarded. i got this letter because the field office here had all the papers from there send to them here. when i walked in there and showed them everything i had they were confused about why it would even be in memphis. a number is the same, it doesnt have a receipt number or priority date on.

i thought that if i get denied that all the offices would see it by pulling up my files. but they didnt see anything other than that my i89 was missing. and it has been 5 years since it got denied and i have recieved other letters but nothing was ever said about it being denied. shouldnt they have seen it?

it said on the denied letter that procedures for my deportation are to follow and i havent gotten anything about that. the office here put a note to it that this was everything from memphis. so a procedure letter has never been written.

now after i checked all my papers i saw that i have one letter that says they got my change of address. that is the only one. i have not gotten anything from the different changes. but i have recieved letters at every address. so they had the right address.
maybe the texas office never informed the memphis office about it?

i am getting a lawyer and see what they say.
i hope it was all just a mistake and because they had some papers in memphis the san antonio office couldnt finish.

i am just really scared to go to the appointment now.
what would happen to the kids? i cant even reach my husband and let him know. could the i89 letter be a trap?
tomorrow first thing i am calling a lawyer.

i mean they had my addresses but never have i gotten anything about being deported other then the one i have not recieved until yesterday, datet september 2004. you would think they would try to reach you again.

the letter to go to the interview which i had to rescedule was sent to the address after the one they sent the denial letter too. the appointment was in dallas. so it came from the texas office. i have never been to a tennessee office

In as much as you have a deportation order, please see an attorney for help. It may be worth the cost for him to attend the interview with you. Your situation is too serious to look for help on a forum.
