confused situation

I have a problem. Our H1 Visa is expiring this month end & we have filed I485 in July 2001 & not yet approved. I called IIO this week & found out our case is assigned to an officer last week. I am working on EAD for another company after being laidoff from the sponsored company . what should i do now. will we be in status after this month end?
Also if i have to renew my EAD how should i go about since i have left the sponsored company?

you don\'t need any documents from the company to file for an extension

Just yr receipt notice and old EAD

Yuo don not nned any documents or lawyer to apply for EAD extension. I think it is a simple procedure. However apply atleast 3 months in advance.

Can we directly send the receipt & EAD ourself , no need to go through attorney? How many months before expiration of EAD we should do this?
 
Did you transfer H-1s when you switched employers?.

If you did, then you can extend H-1 or use EAD.

 If you did not transfer H-1B when you switched and instead used the issued EAD to take another job the H1-B is no longer valid so its irrelevant that your H-1 is expiring end of the month. Filing your 485 gives you the legal status in US (rather than H-1B) and the EAD enables you to work. So if you did not transfer H-1s the existing H-1 is invalid and a worthless piece of paper, you are legal though because you filed 485 (aka changing status). You only now need to be concened about extending EADs till you get the card. Meanwhile, prepare to document/answer questions about similarity of job descriptions and employment benefits should the need arise in case of RFE/GC interview. Hope this helps.

For EAD extension, do we have to mail it to VSC or can we get it from Local INS?
Actually, I have taken "interim EAD" from local INS and my wife got it from VSC because my company did not apply for me as I am on H1.

In my case(interim EAD) how can I go for extension?

Any comments will be appreciated?

H1 expiry doesn\'t matter. However, you should know that one of more of the following that may apply to you after H1 expiry:

1. If you have to travel outside of US, you must apply fot Advance Parole.
2. If you have 90 days or more before EAD expiry, you can just go to a local INS distict office and have your EAD renewed.

I suggest: apply for EAD renewal with 120 days of the expiry so as to avoid any headaches.

What I understand is, 1. EAD directly from Service Center and 2.the Interim EAD obtained in local INS of a state can be renewed with any other state(because I moved) local INS. ie. both can be renewed at Local INS with 120 days to expire.
