confused, need help: DS 230 Part 1 Question about Education Information

Hello folks,

I have a question about DS 230 Part-I, item 23 (List of all Educational Institutions attended). My attorney was not very convinced on this issue, and could not help to resolve my confusion.

I am currently pursuing a Masters Degree (part-time) from a US University.
I am not sure if including this education in form DS-230 Part-I could be risky.

I am in EB3, with my job having absolutely no requirement for Masters Degree.
My B.Tech degree from India fulfills my GC job requirement. I still included this education because the question is "List all Educational Institutions attended". So, excluding an "in-progress" Education might be looked upon as "Concealment of material facts". On the other hand, since I have not yet completed the degree, I can only present course transcripts, and CANNOT present the final Degree Certificate. So, they should not send me back in "Immigration Pending" status, asking me to submit the final Degree Certificate for my Masters Degree.

I need some advice on whether I should include, or exclude this Masters education from my DS 230 form. Any advice/suggestions/apprehensions that you gurus might share would me, would be tremendously appreciated.

{You can fill in the facts about the Masters Degree you are currently
pursuing. They would not ask for transcripts or degree}

I did mention "Present" in the to field, and "Master of Science In Progress" in the degree field. I am not sure though, if that would suffice.

I would greatly appreciate any other feedback.
