I am in a little dilema and would appreciate any help from you giys out there. I am currently on a H1B Visa, currently on the extension. I dont have multiple entry stamped on my passport and my I-94 has expired. I have recieved my Landing papers for Canada and would like to land soon, but I am worried that as I dont have a multiple entry visa, I would have problems re-entering the US after ai have completed my landing formalities.

I know that legally if I have a valid I-797(H1B approval notice), I am allowed to come back to the US without a visa within 30 days, but the looking at the current situation, I have doubts about ym safe passage back. What should be my best strategy to re-enter US in this situation, using the H1B or using the Canadian PR ?

From the info I learned on this forum,

I would use the H-1B status to return to the states. Lots of us returned using I-797 without visa before 9/11. Do check with the state dept regarding their newest regulations.

A landed imigrant with a valid 797 is eligible

You can return back to US as long as you have a valid 797 paper which has a 1-94 attached to it. The white i-94 will not be considered if you are a landed immigrant. All they look at the border is your passport, your 797 ( the I-94 in that will be checked ) and landed immigrant status and a couple of questions!
Better have all the documents with you, you latest paycheck and stuff, nowadays they are looking for valid reasons to let you in, so if you have a valid work, work permit, and are a landed immigrant, there is no problem.
But do remember they can ask you any kind of proof to prove your canadian landed immigrant status. Usually they don\'t but they have the right to ask them.

Length of stay in Canada

I know that as a tourist from the U.S. I can stay in Canada for six months. However, what I don\'t understand is whether that is six months continuous stay, or six months per calendar year? Example: What if a job allows a person to travel. Let\'s say the subject stays in Canada for 4 month durations twice a year. That would be 8 months per calendar year. Would this be legal?
