We are on H4 and H1B. The visa stamped on our passports is by a company "A" with the expiry date of March/2006 (so not expired yetl). But the "white I-94 card" that we have stapled on our passports still reflects my husband's old company "B" I-94 date of July/2004 (so, expired). We have not gone out of country since 2.5 years, that is why our "white cards I-94" shows old dates.
Now, 2 weeks back, my husband has joined company "C" and transfered his H1B, also he got his original H1-B 797 approval notice in one week, using premium processing. But unfortunetly my H4 approval notice has NOT yet received. He has not joined this company "C" though, so he is not on their payroll yet. But as just said, his H1 is transfered already.
Now, we wanted to go to Canada and come back in one week starting this coming Tuesday (Dec/27/2005). Can i get problems doing port of entry (because i have not got my H4 797 approval notice yet) ?
We are thinking of showing company "A" approval notices if asked by immigration personels. Through this company "A", we both have our original I-797 Approval Notices i.e H1 and H4.
We are thinking of using company "A" papers since their visa is stamped on our passports, having approval notices, and this visa is still not expired.
can somebody please share advises, if we are doing any blunder OR is it OK ?
Also, if somebody has any ideas --- what happens to the old visa (not expired), if a different company has transfered H1-B.... does the old one automatically gets canceled or what happens exactly ?
