Confused about my Check rejection!

Hi all,

I have recently applied for a GC and EAD based on my husband's citizenship. I have mailed I-130, I-485 and I-765 as a package to Chicago lockbox. I included separate checks for all the forms.
$930 for I-485,
$340 for I 765
$80 Biometric fee
$355 for I-130

I received three letters from the USCIS,
1. one saying that my I-765 was received (with the receipt number)
2. One saying that the I-130 was received (with the receipt number)
3. One is sent along with the return of my check for I 765 (with a receipt number) saying that the amount was not required or the wrong amount was sent. Letter type - 'REJECTION NOTICE' It also said that no further action was required from my side.

When I called the USCIS, the lady told me that the fee was returned because it was not required while filing together with I-485, it was not the rejection notice for the application and that the receipt numner on the letter was actually my I-485 receipt number.

Now, even though the USCIS lady's assurance relieves me a little bit, I would like to know if anyone had the same experience and if I can rely on what she is saying. Unfortunately, I am not able to retrieve any information on the website based on any of my receipt numbers as it says they do not exist.
ANY IDEAS? Thanks much.

What that means is EAD's when filed concurrently with an I 485 application are free. Since when did USCIS start doing that?

The instructions state that if you've applied after the fee increase and you apply for the I-130 ($355) and the I-485 ($1010), then the I-131 and I-765 forms are free of charge.

So - just be glad they didn't cash the check and try to keep the money. Enjoy the extra feee dollars for Christmas! :D

TNGuy,

where is that written? maybe I missed it. I just filed an I130 and I485 for my wife and we didnt file for the I131 / I765 as she is still in school. So is it still possible to file an I131 and I765 without attaching a check? and if so how would USCIS know to process that for free?

It is on the USCIS website for the forms, and on the instructions.

Yes, you can file I-131 and I-765 for her with a copy of the I-485 receipt and no check.

On the I-485 filing instructions - Page 7 regarding Filing Fees.

NOTE: Effective July 30, 2007, if you file Form I-485 to adjust your status as a permanent resident, no additional fee is required to also file an application for employment authorization on Form I-765 and/or advance parole on Form I-131. You may file these forms concurrently. If you choose to file the I-765 and/or I-131 separately after the effective date, you must also submit a copy of your I-797C, Notice of Action, receipt as evidence of the filing of an I-485.

You may file the I-131 and I-765 concurrently with your I-485, or you may submit the I-131 and/or I-765 at a later date. If you file Form I-131 and/or I-765 separately, you must also submit a copy of the receipt for your Form I-797C, Notice of Action, as evidence of the filing of an I-485.
